FROM LEGAL ORDER TO SYSTEM IN CLASSICAL ISLAMIC LAW: A COMMUNICATIONAL ANALYSIS

The article explores the distinction between legal order and legal system in Sharia based on the Communicational Theory of Law. The legal order is a textual entirety that, in itself, is inoperative because it requires the legal system for rules to be properly delimited and interpreted. Through the emergence and development of Sharia and fiqh, we analyze the historical development through which the different legal systems of Sunni Islam are formed. This analysis leads us to confirm the distinction between legal order and system advocated by the Communicative Theory of Law, concluding that there are as many systems as there are schools, and consequently, as many Sharias as there are schools
