Confronting Our Normative Tradition. Treatment of Cases of Uxoricide, Rape and Sexual Submission in Salmantine Scholasticism

Abstract
The article analyses how 16th- and 17th-century Spanish Scholasticism—in which the School of Salamanca played a central role—addressed issues of sexual morality now linked to gender philosophy, such as femicide and rape (using the period’s own terms, such as uxoricide, stuprum and coitus per vim). By studying the perspectives of authors such as Francisco de Vitoria and Domingo de Soto, and paying particular attention to the sacramental theology of marriage, the article examines treatises such as that of Pedro de Ledesma (1592) and contrasts the theological and philosophical perspectives of the Salamancan scholastics with the legal approaches of Diego de Covarrubias. Later theological-moral compendia, such as that of Antonio de Escobar (1652), are also mentioned to demonstrate the richness and historical relevance of this Spanish normative tradition, which continues to inform current ethical debates.
