Abstract

The teaching of Fundamental Rights, basic in Constitutional Law, based on
Literature, is one of the methodologies that can provide a deep learning of the
meaning and value of Fundamental Rights on the basis of human dignity. Many
times the teaching and learning of Law is too formalistic and positivist, reluctant to
new approaches. This work aims to reflect the possibilities provided by the use of
Literature from different eras and genres in the teaching and learning of
Constitutional Law, especially that of Fundamental Rights, starting, in this case,
from the work F. Kafka The Process.
