Abstract

This scientific article aims to demonstrate that the content of fundamental
rights, understood in their international and more specifically conventional
perspective in interpretation given by the European Court of Human Rights,
permeates (or should permeate) the actions and even the essence of various public
powers. institutional (“organic part” of the Constitution), beyond the traditional
analyzes that circumscribe its force of binding only on fundamental rights
(“dogmatic part” of the Constitution).
